Your data is collected when you communicate it to us. This can, for example, be data that you enter in a contact form. Other data is collected automatically when you visit the website and through the use of our services. This is primarily technical data (e.g. internet browser, operating system or time of the page call). 

 

What do we use your data for? 

Part of the data is collected to ensure the error-free provision of the website and other services. Other data can be used to analyze your user behavior. Details on this and a precise description of the individual data processing activities are given below. 

 

What rights do you have regarding your data? 

You have the right to receive information about the origin, recipient and purpose of your stored personal data at any time. You also have the right to request the correction, restriction of processing or deletion of this data. In addition, you have the right to request the data transferred to us as a file. You can contact us at any time at the address given in the imprint if you have any further questions on the subject of data protection. You also have the right to lodge a complaint with the competent supervisory authority. 

 

Analysis tools and third-party tools 

When you visit our website, your surfing behavior can be statistically evaluated. This is mainly done with cookies and so-called analysis programs. The analysis of your surfing behavior is usually anonymous; surfing behavior cannot be traced back to you. You can object to this analysis or prevent it by not using certain tools. (3) When you contact RADEMACHER by email, or via a contact form, we will store the data you provide (your email address and your name and telephone number where applicable) in order to respond to your enquiry. We delete the data acquired in this way once its storage is no longer necessary. Alternatively, we will restrict the processing of the same if there are statutory retention obligations. 

 

(4) If we make use of commissioned service providers for individual features of our service offering, or if we wish to use your data for advertising purposes, we will inform you below in detail about the relevant processes. We will also specify the specific criteria for the storage period. 

 

 

COLLECTION OF PERSONAL DATA WHEN YOU VISIT OUR WEBSITE 

 

(1) When you use our website without registering, or when you transmit information to us by some other means, we only collect the personal data transmitted to our server by your browser. If you wish to view our website, we collect the following data, which we require for technical purposes, in order to show you our website and ensure its stability and security:

  • Time zone difference to Greenwich Mean Time (GMT) 
  • Content of the request (specific page) 
  • Access status/HTTP status code 
  • The volume of data transferred in each case

This data will be deleted automatically when you leave the website. 

The legal basis of this processing is the legitimate interest of RADEMACHER, which is to ensure the protection and the stability of its website. 

 

(2) We use cookies on our web pages. Cookies are small text files which are assigned to the browser you are using and are stored on your hard drive. They allow certain information to be sent to the party placing the cookie. Cookies cannot run any programs or transfer viruses to your computer and are therefore harmless. They are used to make the website more user friendly and effective overall, in other words more pleasant for you. 

 

Cookies may contain data that enables recognition of your device. Cookies sometimes also only contain information about certain settings however which cannot be attributed to an individual. Cookies cannot directly identify a user however. 

 

A distinction is made between session cookies, which are deleted as soon as you close your browser, and permanent cookies which are saved beyond an individual session. In terms of function, a distinction is made between: 

  • Technical cookies: These are necessary to navigate around the website, use basic functions and ensure the security of the website.  
  • Performance cookies: These collect information about how you use our website, which pages you visit and, for example, whether any errors occurred during your use of the website. They do not collect any information that can identify you. All the information collected is anonymous and is only used to improve our website and ascertain our users’ interests. 
  • Advertising cookies, targeting cookies: These are used to offer web page users appropriate advertising on the website or offers from third parties, and to measure the effectiveness of those offers. Advertising and targeting cookies are stored for a maximum period of 13 months. 
  • Sharing cookies: These are used to improve how our website interacts with other services (e.g. social networks). Sharing cookies are stored for a maximum period of 13 months. 

 

Any use of cookies that is not strictly necessary for technical reasons constitutes data processing which is only permitted with your express and active consent. This applies in particular to the use of advertising, targeting or sharing cookies. In addition, we will only forward your data processed by means of cookies to third parties where you have expressly consented to. 

On the other hand, we use technically necessary cookies due to our legitimate interest in the intended display and use of our website.

CONTACT FORM 

 

(1) If you fill out the contact form, you consent to us storing your contact details to clarify the request. If you send us other inquiries via contact forms, your details from the inquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the inquiry and in the event of follow-up questions. We do not transfer this data without your consent. 

 

(2) The processing of the data entered in the contact form is therefore exclusively based on your consent. You can revoke this consent at any time. An informal message by e-mail to us is sufficient.  

 

(3) We keep the data of the contact form until you ask us to delete it, revoke your consent or the purpose for data storage no longer applies (e.g. after your request has been processed). Mandatory legal provisions – in particular retention periods – remain unaffected. 

 

ADDITIONAL FEATURES AND OFFERS ON OUR WEBSITE 

 

(1) In addition to the use of our website, we provide various services which may be of interest to you. To use these services, you will generally need to provide additional personal data which we will use to provide the service in question and to which the abovementioned basis for data processing will apply. 

 

(2) We sometimes use external service providers to process your data. We have selected and commissioned these carefully. They are bound by our instructions and are reviewed on a regular basis. 

 

(3) We may also forward your personal data to third parties when we run campaigns or competitions, conclude contracts with or offer similar services jointly with partners. You will be given more information about this when you provide your personal information or below in the description of the offer. 

 

(4) If our service provider or partner has its registered office in a country outside the European Economic Area (EEA), we will tell you about the consequences of this in the offer description. 

 

  • 3 NEWSLETTERS 

 

(1) With your consent, you can subscribe to our newsletter which we use to keep you informed about our latest special offers. The goods and services promoted are specified in the declaration of consent. 

 

(2) We use the so-called double opt-in procedure for subscription to our newsletter. This means that when you subscribe, we will send an email to the email address you specified in which we will ask you to confirm that you wish to receive the newsletter. If you do not confirm your subscription within 24 hours, your information will be blocked and will be automatically deleted after a month. We also save your IP address and the time of your subscription and confirmation in each instance. The purpose of this is to prove your subscription and, where applicable, to be able to resolve any potential misuse of your personal data. 

 

(3) The only information required to send you the newsletter is your email address. The provision of other data is optional and will be used so we can address you personally. After you confirm, we will save your email address so we can send you the newsletter. The legal basis for this processing is your consent. 

 

(4) You can revoke your consent to the sending of the newsletter and unsubscribe from the newsletter at any time. You can revoke said consent by clicking the “Unregister” link provided in every newsletter email, by sending an email to info@rademacher.de, or by sending a message to the contact details provided in the Legal Notice. 

 

 

  • 4 USING OUR WEB SHOP

 

CUSTOMER ACCOUNT 

 

When you create a customer account, we collect your personal data to the extent specified there. The purpose of data processing is to improve your shopping experience and to simplify order processing. 

 

Your data will be processed when you create a customer account with your consent. You can revoke your consent at any time by notifying us. Your customer account will then be deleted. 

The personal data stored in your customer account, including your purchase history, will be stored for the period of the business relationship. After a customer account has been closed, this data is properly deleted, unless we are legally obliged to store it for a longer period of time, for example due to accounting retention requirements. 

The processing of your personal data stored in the customer account, including the purchase history, is based on the execution of a contract. 

 

ORDER PROCESS 

 

All data entered by the customer as part of an order processing is saved. This includes: 

  • First and last name 
  • Address 
  • E-mail address 
  • Payment data 

 

We only transmit personal data to third parties if this is necessary in the context of contract processing, for example to the company entrusted with the delivery of the goods or the bank responsible for processing the payment. You are given the opportunity to voluntarily forward your e-mail address to the company responsible for shipping for the purpose of shipment tracking. Any further transmission of the data does not take place or only if you have expressly consented to the transmission. Your data will not be forwarded to third parties without your express consent, for example for advertising purposes. 

The basis for data processing is the execution of a contract. 

 

SHIPMENT TRACKING WHEN SHIPPING WITH DHL 

 

If your goods are delivered by the shipping service provider DHL and you have expressly consented to the transfer of your email address during the ordering process, it will be sent to DHL to announce the delivery or to coordinate it of the delivery date. The legal basis for data processing is your consent if. If you do not agree to the forwarding of the email address, the delivery will be made via DHL without tracking. An announcement of the delivery or a coordination of the delivery date by DHL is then not possible. 

A given consent to the use of data can be revoked at any time for the future. To do this, please contact the person responsible for data processing or the shipping service provider directly. 

 

PAYMENT SERVICE PROVIDER 

 

RADEMACHER offers various payment methods on its website, listed below. Depending on the country in which you reside, some payment methods may not be available. 

 

(1) Payment via Paypal  

 

It is possible to process the payment using the online payment service PayPal. PayPal makes it possible to make online payments to third parties. The European operating company of PayPal is PayPal (Europe) S.à.rl & Cie. SCA, 22-24 Boulevard Royal, 2449 Luxembourg. If you choose PayPal as the payment method, your data required for the payment process will be automatically transmitted to PayPal. This regularly involved the following data: 

  • Last and first name 
  • Address 
  • Company 
  • E-mail address 
  • Telephone number 
  • IP address 

 

The data transmitted to PayPal may be transmitted to credit agencies by PayPal. The purpose of this transmission is to check identity and creditworthiness. PayPal may also pass on your data to third parties if this is necessary to fulfill contractual obligations or if the data is to be processed on behalf of the customer. 

 

The legal basis for data processing is the execution of a contract since the processing of the data is necessary for payment with PayPal and thus for the execution of the contract.

(2) Payment via immediate transfer 

 

If you choose to pay by instant transfer, your data will be collected by Sofort GmbH, Theresienhöhe 12, 80339 Munich. Sofort GmbH which is part of the Klarna Group. Data collection and storage does not take place at Rademacher. 

Sofort GmbH needs the IBAN, PIN and TAN of your online banking account for this. As part of the ordering process, you will be automatically forwarded to the secure Sofort GmbH payment form. Immediately afterwards you will receive the confirmation of the transaction. 

The legal basis for data processing is the execution of a contract, since the processing of the data is necessary for payment by direct transfer and thus for the execution of the contract. Further information on data processing can be found at https://www.klarna.com/sofort/ 

 

(3) Payment by credit card (Visa / Mastercard / Maestro) 

 

If you choose to pay by credit card, you have the option of paying for your order with a Visa or Mastercard. In order to enable payment by credit card, your personal data will be transmitted to the respective credit card company in connection with the payment. Your personal data is transmitted for the purpose of fulfilling the contract. 

 

(4) Payment via Giropay 

 

You also have the option of making payments using the provider Giropay, an offer from paydirekt GmbH, Stephanstraße 14-16, 60313 Frankfurt am Main, which connects you to your bank's online banking. In this case, your transaction data will be transmitted to Giropay. Giropay transmits this information to your bank. The legal basis for transmission to Giropay is the fulfillment of the contract concluded with you. (5) Payment processing via Unzer 

 

We use the services of Unzer (Unzer E-Com GmbH, Vangerwostraße 18, 69115 Heidelberg, Germany) to forward the payment data to the respective payment service provider and to process the payment. In the following, Unzer transmits your data to the respective agency required for payment, such as the respective payment institute or the credit card provider or the provider of the respective payment method as well as other service providers of Unzer. A transmission to Unzer and the transfer of your personal data by Unzer takes place exclusively on the basis of your express consent which you gave us during the payment process by ticking the corresponding checkbox. You can revoke your consent at any time with effect for the future. In addition, we have a legitimate interest in ensuring that we actually receive payments from customers for orders placed via our website. 

 

As part of payment processing, it may also be necessary for Unzer to transfer your data to a so-called third country, i.e. a country outside the EU or EEA. Transmission to third countries will only take place if there is an adequacy decision, on the basis of suitable guarantees or if there is an exception in accordance with Art. 49 GDPR, which exceptionally allows transmission to a third country even without the existence of suitable guarantees. 

 

 

 

  • 5 SERVICE CENTER, ZENDESK

 

(1) We use the system provided by Zendesk Inc., 1019 Market Street San Francisco, CA 94103, USA (“Zendesk”) to process service, support and other help requests, and to operate RADEMACHER. We use Zendesk so we can process your requests quickly and efficiently. The legal basis for this processing is the legitimate interest of RADEMACHER. 

 

(2) We have concluded a Data Processing Agreement (DPA) with Zendesk. Under the terms of said agreement, Zendesk is obliged to only use our customers’ user data to process requests within the framework of the EU data protection standards, and not to disclose the same to third parties. We have agreed upon EU standard contractual clauses for this purpose which have been expanded to include the current requirements of the data protection supervisory authorities. This ensures that a level of data protection equivalent to the GDPR is ensured even in the case of a data transfer to the USA.

(4) When you contact RADEMACHER, we may need to use TeamViewer software. This software allows our support team to remotely view your installation and perform various configurations on your installation. This remote control is only possible with your agreement. To operate, you have to install the tool on your computer and send us a login and a password.   • 6 PRODUCT REVIEWS – BAZAARVOICE

 

(1) You have the option of creating product ratings on our website. In doing so, we record the personal data you have entered. Mandatory information is marked accordingly in the form, the others information are optional. The ratings you enter will be displayed on our website and may also be displayed on other websites that also sell the rated product. 

 

(2) We use the service provider Bazaarvoice Inc., 10901 Stonelake Blvd, Austin, TX 78759 USA (“Bazaarvoice”) to create, evaluate and moderate product reviews. In doing so, Bazaarvoice will have access to the personal data you have entered in the evaluation form. Bazaarvoice is also entitled to display the reviews you have submitted on other websites that are part of the Bazaarvoice network, so that subsequent customers are able to make an informed purchase decision based on the large number of reviews. The processing of your personal data in connection with the creation of product reviews, in particular the transmission to Bazaarvoice, takes place exclusively on the basis of your express consent which you have given by ticking the corresponding checkbox of the evaluation form. You are not obliged to give your consent, but in this case, it is not possible to create an evaluation. You can revoke your consent at any time with effect for the future.  

 

(3) Bazaarvoice also collects and processes personal data about product interests, navigation on the website or transaction data that may already be collected when using the website. We use these findings to analyze your use of our website and to make it even better in the future. This data processing is also carried out exclusively on the basis of your express consent which you have given us via the cookie banner and which you can revoke at any time with future effect. 

 

(4) To protect your personal data, we have agreed the standard data protection clauses of the European Commission with Bazaarvoice after a risk assessment has been carried out.   • 7 WEB ANALYTICS

 

  1. Use of Google Analytics

(1) This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files stored on your computer which enable analysis of your use of the website. Information generated by the cookie relating to your use of the website is generally transmitted to and stored on one of Google's servers in the USA. However, if IP anonymisation is activated on this website, your IP address will be shortened by Google beforehand within member states of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases is the full IP address transmitted to one of Google's servers in the USA and shortened there. Google uses this information on behalf of the operator of this site to evaluate your use of the website, to compile reports on website activities, and to provide the website operator with other services related to use of the website and the internet. 

 

(2) The IP address transmitted by your browser as part of Google Analytics is not combined with any other data held by Google. 

 

(3) You can prevent storage of the cookies by changing the respective settings in your browser. However, we wish to point out that some functions offered by the website will not be fully available in this case. Furthermore, you can prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) by Google, as well as the processing of this data by Google, by downloading and installing the browser plug-in available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en-GB. 

 

(4) This website uses Google Analytics with the “_anonymizeIp()” extension. This means that IP addresses will be processed in truncated form thus preventing them from being directly linked to a particular individual. Where the data collected about you contains a personal reference, this will be excluded straight away and the personal data will then be erased immediately. 

 

(5) We use Google Analytics so we can analyse and regularly improve the use of our website. We can use the statistics obtained to improve our site and make it more interesting and attractive for you as a user. For the exceptional cases in which your personal data is transferred to the USA, we have agreed upon EU standard contractual clauses with Google which have been expanded to include the current requirements of the data protection supervisory authorities. This ensures that a level of data protection equivalent to the GDPR is ensured even in the case of a data transfer to the USA.

This website uses so-called Web Fonts provided by Google to ensure the uniform use of fonts on this site. These Google fonts are locally installed so that a connection to Google’s servers will not be established in conjunction with this application.   1. Google Tag Manager

(1) Google Tag Manager enables the management of marketer website tags via an interface. The Tag Manager itself, which uses the tags, works without cookies however and does not record any personal data. The Tag Manager only activates different tags which may in turn record data. Relevant explanations about these various third-party providers can be found in this Data Protection Declaration. The Google Tag Manager does not use this data however. If you have disabled cookies through your browser settings, or by some other means, this will be taken into account for all tracking tags that have been used with Google Tag Manager. The tool will not change your cookie settings. 

 

(2) Google may ask for your consent to send some product data (e.g. your account information) to other Google products in order to enable certain functions, e.g. to make it easier to add new conversion tracking tags for AdWords. Google’s developers also check information about product use from time to time in order to further optimise the product. Google will never forward data of this nature to other Google products without your consent however.

  1. Use of Google Ads conversion tracking

We use the online advertising program "Google Ads" on our website and, in this context, conversion tracking (evaluation of visits). Google Conversion Tracking is an analysis service provided by Google LLC (1600 Amphitheater Parkway, Mountain View, CA 94043, USA; "Google"). If you have your habitual residence in the European Economic Area or Switzerland, Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) is responsible for your data. If you click on an ad placed by Google, a conversion tracking cookie will be placed on your computer. These cookies have a limited validity, do not contain any personal data and are therefore not used for personal identification. The information obtained using the conversion cookie is used to generate conversion statistics. This tells us the total number of users who clicked on one of our ads and were redirected to a page with a conversion tracking tag. However, we do not receive any information with which users can be personally identified. Your data may be transmitted to the USA. The data processing, in particular the setting of cookies, takes place with your consent. You can revoke your consent at any time. You can find more information and Google's privacy policy at: https://www.google.de/policies/privacy/ 

 

  1. AWIN Affiliate Program

This website uses the performance advertising network of AWIN AG, Eichhornstraße 3, 10785 Berlin. As part of its tracking services, AWIN stores cookies on the end devices of users who visit or use its customers’ websites or other online offers (e.g. register for a newsletter or place an order in an online shop) to document transactions (e.g. leads and sales). 

These cookies serve the sole purpose of correctly allocating the success of an advertising medium and the corresponding billing within its network. 

The AWIN tracking cookie does not store any personally identifiable information. Only the identification number of the affiliate, as well as the serial number of the visitor to a website and the clicked advertising material are stored. The purpose of storing this data is to process commission payments between a merchant and the affiliate, which are processed via the affiliate network, i.e. AWIN. 

The AWIN cookie is stored on the basis of your consent in accordance. You can prevent cookies at any time by means of a corresponding setting in your browser and thus permanently object to the setting of cookies.

  • 8 SOCIAL MEDIA

 

  1. Use of social media plug-ins

 

(1) We currently use the following social media plug-ins: Facebook, Twitter, Xing, LinkedIn, Instagram, Pinterest and YouTube. We use the so-called two-click solution for these. That means that when you visit our site, at first no personal data is sent to the plug-in provider at all. You can recognise the plug-in provider by the marking on the box or by its initials or the logo. We give you the opportunity of communicating with the plug-in provider directly via the button. The plug-in provider only receives the information that you have visited the relevant web page of our online site when you click the marked field, thereby activating it. The data specified in point 3 of this declaration is also transmitted. In the case of Facebook and Xing, the IP address is anonymised immediately after collection in Germany according to information from the respective providers. By activating the plug-in, personal data about you is then transmitted to the respective plug-in provider and is stored there (in the USA in the case of American providers). Since the plug-in providers collect data, in particular, through cookies, we recommend deleting all cookies via the security settings in your browser before clicking the greyed-out box. 

 

(2) We have no influence over the data collected or the data processing procedures and we are unaware of the full extent of the data collection, the purposes of the processing or the retention periods. We also have no information about erasure of the data collected by the plug-in providers. 

 

(3) The plug-in provider saves the data collected about you as a user profile and uses this for advertising, market research and/or demand-oriented design purposes for its website. Such an analysis is done in particular (even for users who are not logged in) in order to display appropriate advertising and to inform other users of the social network about your activity on our website. You have the right to object to the creation of this user profile. You must contact the plug-in provider in question to exercise this right. Through the plug-ins, we provide you with the option to interact with the social networks and other users so we can improve our site and make it more attractive and interesting for you as a user. The legal basis for using the plug-ins is your consent. 

 

(4) The data is transferred regardless of whether or not you have an account with the plug-in provider and are logged in to it. If you are logged in with the plug-in provider, your data collected on our site will be associated with your existing account with the plug-in provider. When you press the activated button and, for example create a link to the page, the plug-in provider also stores this information in your user account and shares it with your contacts publicly. After using a social network, we recommend you log out periodically, but in particular before activating the button as you can avoid association with your profile with the plug-in provider.

(2) Our company accounts on Instagram and Facebook are also integrated into our Zendesk system for the purpose of fast and efficient processing. If you send us a message via the respective pages, it will be processed by us via Zendesk. The use of your data on the Facebook or Instagram pages by the providers cannot be influenced by us as page operator. 

 
(3) We keep the messages you send until you request us to delete them or the purpose for storing the data no longer applies (e.g. after processing your request has been completed). Mandatory legal provisions - in particular retention periods - remain unaffected. 

 
(4) Zendesk has Binding Corporate Rules (BCR) that have been approved by the Irish Data Protection Authority. These are binding corporate rules that legitimize corporate data transfers to third countries outside the EU and EEA. 3. Integration of YouTube videos 

 

(1) We have integrated YouTube videos in our website which are stored at http://www.YouTube.com and can be played from our website directly. These are all integrated in “enhanced data protection mode”, in other words no data about you as a user is sent to YouTube unless you play the videos. The data specified in paragraph 2 is only transmitted when you play the videos. We have no influence over this data transmission. 

 

(2) By visiting the website, YouTube receives the information that you have accessed the sub-page of our website in question. The data specified in point 3 of this declaration is also transmitted. This happens regardless of whether YouTube provides a user account you are logged in to and even if you have no user account. According to Facebook’s statement the collected data will be transferred to the USA and other third-party countries too. 

This tool allows the tracking of page visitors after they have been linked to the website of the provider after clicking on a Facebook ad. This makes it possible to analyze the effectiveness of Facebook ads for statistical and market research purposes and to optimize future advertising campaigns. 

For us as the operators of this website, the collected data is anonymous. We are not in a position to arrive at any conclusions as to the identity of users. However, Facebook archives the information and processes it, so that it is possible to make a connection to the respective user profile and Facebook is in a position to use the data for its own promotional purposes in compliance with the Facebook Data Usage Policy. This enables Facebook to display ads on Facebook pages as well as in locations outside of Facebook. We as the operator of this website have no control over the use of such data. 

The use of Facebook Pixel is based on your express consent via the cookie banner. The purpose of the processing is to carry out effective advertising measures, including social media. The consent can be revoked at any time.

(1) We use HubSpot for our online marketing activities. This is an integrated software solution which we use for various aspects of our online marketing. HubSpot is a software company from the USA with a branch in Ireland: HubSpot, 2nd Floor 30 North Wall Quay, Dublin 1, Ireland (“HubSpot”). 

 

Areas in which HubSpot is used: 

  • Content management (website and blog) 
  • Email marketing (newsletter and automated mailings, for example for the provision of downloads) 
  • Reports and analytics 
  • Contact management (CRM) 
  • Landing pages and contact forms 

 

(2) With our subscription service (e.g. newsletter), we enable our website visitors to find out more about our company, download content and provide contact information and other demographic information. This information will be stored on the servers of our software partner HubSpot. It may be used by us to contact visitors to our website and to determine which of our company’s services may be of interest to them. 

 

(3) For the exceptional cases in which personal data is transferred to the USA, we have agreed upon EU standard contractual clauses with HubSpot which have been expanded to include the current requirements of the data protection supervisory authorities. By doing so, we are pursuing the aim of showing you advertising that is relevant to you to make our website more interesting and attractive for you.

We have no influence over the extent and subsequent use of the data collected by Facebook using these tools, and we are therefore informing you in line with our own knowledge of the same: The integration of Facebook custom audiences means that Facebook receives information that you have accessed the web page in question on our website or that you have clicked one of our advertisements. If you have registered for a Facebook service, Facebook can associate the visit with your account. Even if you are not registered with Facebook, or are not logged in, there is the possibility of the provider obtaining and storing your IP address and other identifying features.

  • 10 AUDIO AND VIDEO CONFERENCING

 

Data processing  

We use online conference tools, among other things, to communicate with our customers. If you communicate with us via video or audio conference over the Internet, your personal data will be collected and processed by us and the provider of the respective conference tool. 

 

The conference tools collect all data that you provide/use to use the tools (e-mail address and/or your telephone number). Furthermore, the conference tools process the duration of the conference, start and end (time) of participation in the conference, number of participants and other "context information" in connection with the communication process (metadata). 

 

Furthermore, the provider of the tool processes all technical data that is required to process online communication. This includes in particular IP addresses, MAC addresses, device IDs, device type, operating system type and version, client version, camera type, microphone or loudspeaker and the type of connection. 

 

If content is exchanged, uploaded or provided in any other way within the tool, this is also stored on the servers of the tool providers. Such content includes but is not limited to cloud recordings, chat/instant messages, voicemails, uploaded photos and videos, files, whiteboards and other information shared while using the Service. 

 

Please note that we do not have full influence on the data processing operations of the tools used. Our options are largely based on the corporate policy of the respective provider. Further information on data processing by the conference tools can be found in the data protection declarations of the tools used, which we have listed below this text. 

 

Purpose and legal bases 

The conference tools can be used to communicate with prospective or existing partners or to offer services to our customers. In this case, the legal basis of the processing is the execution of a contract. Otherwise, the tools are usually used on the basis of your express consent. Furthermore, we use the tools in accordance with our legitimate interest which is to simplify and accelerate communication with us.  

 

Storage duration 

The data collected directly by us via the video and conference tools will be deleted from our systems as soon as you ask us to delete it, revoke your consent to storage or the purpose for data storage no longer applies. Saved cookies remain on your end device until you delete them. Mandatory statutory retention periods remain unaffected. 

 

We have no influence on the storage period of your data, which is stored by the operators of the conference tools for their own purposes. For details, please contact the operators of the conference tools directly. 

 

Conference tools used  

We use GoToMeeting. The provider is LogMeIn, Inc., 320 Summer Street Boston, MA 02210, USA. Details on data processing can be found in GoToMeeting's data protection declaration:  https://www.logmeininc.com/de/legal/privacy  

We have concluded an order processing contract with the provider of GoToMeeting and fully implement the strict requirements of the German data protection authorities when using GoToMeeting. 

 

  • 11 DATA SECURITY

 

(1) We have implemented technical and organizational security measures to prevent unwanted access to your data. We have contractually obliged our employees to treat personal data confidentially and carefully. All of our service providers are also monitored by us. During your website visit, we use the common SSL (Secure Socket Layer) procedure in conjunction with the strongest level of encryption supported by your browser in each instance. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we revert to 128-bit v3 technology instead. You can tell if an individual page of our website is being transmitted in encrypted form from the closed appearance of the key and lock icon in the status bar at the bottom of your browser. 

 

(2) We also use suitable technical and organizational security measures to protect your data against random or deliberate manipulation, full or partial loss or destruction, and against unauthorised access by third parties. Our security measures are continually improved in line with the latest technological developments. 

  • 12 HOMEPILOT Portal REMOTE ACCESS SERVICE AND THE HOMEPILOT APP

   

  1. Use of HOMEPILOT Portal without registration

 

(1) You can control your Premium gateway remotely via the internet using our HOMEPILOT Portal remote access service. Only the update service can be used without registering with the HOMEPILOT Portal. As part of the update service, the following data will be transmitted to our server:  

The Premium gateway software version  

The Premium gateway UID  

Date of the request (an update verification is performed every six hours)  

 This data will be deleted 1 year after it is last accessed.  

   

(2) Data processing within the HOMEPILOT Portal will be on the basis of Art. 6(1)(b) of the GDPR. This permits the processing of all data necessary for fulfilment of a contract. When connecting the Premium gateway, and on first starting up the app, you concluded a contract with us for use of the app and the Premium gatewayconnection function.  

   

  1. Use of HOMEPILOT Portal with registration (creation of a user account for HOMEPILOT Portal)

 

(1) For use of the HOMEPILOT app, the personal data you provided during the registration process will be stored in a HOMEPILOT Portal user account. The following technical specifications will also be stored in said user account only when remote access to your  Premium gateway is also approved:

 (2) The data specified above will only be processed for the purpose of providing the app functionality and to technically implement and monitor the Premium gateway.  

   

(3) Data processing within HOMEPILOT Portal and the HOMEPILOT app will be on the basis of execution of a contract. This permits the processing of all data necessary for fulfilment of a contract. When connecting the Premium gateway, and on first starting up the app, you concluded a contract with us for use of the app and the Premium gateway connection function.  

 

(4) The data retrieved via HOMEPILOT Portal and the app will not be combined with other data. This data will only be erased when you unsubscribe from HOMEPILOT Portal. 

   

  1. Data recipients/contract processing

 

(1) The company MarcanT AG, Herforder Str. 163a, Bielefeld, 33609 (“MarcanT AG”) provides the server for the HOMEPILOT Portal and for the HOMEPILOT app. We have concluded a contract processing agreement with MarcanT AG under which the data is only processed on our behalf and in accordance with our instructions.  

   

 

   

  1. Use of the HOMEPILOT Google Assistant app via HOMEPILOT Portal

 

(1) The HOMEPILOT Google Assistant app makes it possible to control the devices in your Premium gateway Smart Home System via Google using voice commands. Google Assistant (provider is Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google")) is a software solution for voice input and output in which voice commands are analysed, interpreted and executed by Google. Google provides an interface for partners which allows those partners to provide their own functions, so-called apps. This allows partners to connect their systems specially and use Google’s voice control.   (2) Google alone will be responsible for the processing of your personal data within the speech processing in Assistant.   (3) As soon as you enable the HOMEPILOT Google Assistant app, the following personal data will be transmitted to Google or will be collected and processed by Google:  

name, description and ID of the devices, sensors and routines which are approved for control in the Google Assistant app  

readings from sensors approved for control in the Google Assistant app.  

  (4) Our HOMEPILOT Google Assistant app also uses Google software. This is used to transmit information needed for the HOMEPILOT Google Assistant app functionality to Google in encrypted form. Google will store this data in the cloud. Personal data may be forwarded to and stored on servers outside the Federal Republic of Germany and the European Union. We have therefore agreed upon EU standard contractual clauses with Google which have been expanded to include the current requirements of the data protection supervisory authorities. This ensures that a level of data protection equivalent to the GDPR is ensured even in the case of a data transfer to the USA. Google alone will be responsible for the processing of your personal data by the Google software and in the Google cloud.    (5) Please note that the data specified in this section will be created by Google, or by a subcontractor, as a user profile with an alias. This may be analysed for advertising or market research or to make the Google Assistant app more user friendly. According to Google, it is not possible to link it back to you directly.  

   

  1. Use of the HOMEPILOT Alexa skill via HOMEPILOT Portal

   

(1) The HOMEPILOT Skill (“Skill”) makes it possible to control the devices in your Premium gateway Smart Home system via Amazon Echo devices using voice commands. Amazon Echo is hardware for voice input and output in which voice commands are analysed, interpreted and executed by Amazon. Amazon provides an interface for partners which allows those partners to provide their own functions, so-called skills. This allows partners to connect their systems specially and use Amazon’s voice control. (2) As soon as you enable the Skill, the following personal data will be transmitted to Amazon and processed by Amazon:

(4) Amazon alone will be responsible for the processing of your personal data by the Amazon software and in the Amazon cloud.   

   

(5) The personal data specified in this section will be created by Amazon, or by a subcontractor, as a user profile with an alias. This may be analysed for advertising or market research or to make the app more user friendly. It is not possible to link it back to you directly.  

 

  1. Google Analytics Firebase

 

(1) We use Google Analytics Firebase to analyze user behavior in our HOMEPILOT app. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4 Ireland.  

 

(2) Google Firebase includes various functions that enable us to analyze your app behavior. In this way we can, for example, analyze your screen views and button presses. We can also determine which features within our app are used frequently or rarely. For these purposes, Google Firebase stores, among other things, the number and duration of sessions, operating systems, device models, region and a range of other data. A detailed overview of the data collected by Google Firebase can be found at:

(3) By using Google Firebase, information is transmitted to Google in encrypted form. This data is stored by Google. Forwarding and storage of personal data on servers outside of the Federal Republic of Germany and the European Union is possible. We have therefore agreed EU standard contractual clauses with Google, which have been supplemented according to the current requirements of the data protection supervisory authorities. This ensures that a level of data protection corresponding to the GDPR is also guaranteed when data is transferred to the USA. Google is solely responsible for the processing of your personal data by the Google software and in the Google Cloud.   

 

(4) Google Firebase is used to optimize our app and to improve our offers. This represents a legitimate interest.

The company MarcanT AG, Herforder Str. 163a, Bielefeld, 33609 ("MarcanT AG") provides the servers for the DECT update. We have concluded an order processing contract with MarcanT AG, according to which data processing only takes place on our behalf and according to our instructions.
